1. General Information

1.1 The following contractual provisions (GTC) apply to all contracts concluded via the online shop of Vermilion Media UG (haftungsbeschränkt), Beethovenstr. 7, 47447, Moers, Germany (hereinafter: SELLER) under the domain oace.de with the customer (hereinafter: CUSTOMER).

1.2 The presentation of products in the SELLER'S online shop constitutes merely a non-binding invitation—a non-binding online catalog—for the CUSTOMER to place an order. By placing an order, the CUSTOMER submits a binding offer to conclude a contract for the items contained in the shopping cart. The SELLER will automatically confirm receipt of the order via email without delay. This automated order confirmation from the shop system does not yet constitute a contractual relationship. A contract is only concluded when the SELLER accepts the CUSTOMER'S offer by delivering the ordered items. The purchase contract is only concluded with this separate declaration of acceptance by Vermilion Media UG (haftungsbeschränkt), Managing Director Nils D. Balters, Registry Court: Kleve HRB 18376.

1.3 Only private individuals are considered CUSTOMERS.

 

2. Amendments

The SELLER reserves the right to update these conditions as needed. Changes will be communicated to the CUSTOMER in a timely manner and will only become effective with the CUSTOMER'S consent.

 

3. Ordering Process

3.1 The CUSTOMER can place desired items in the shopping cart by clicking the corresponding button and initiate the ordering process by clicking on the shopping cart. Within the ordering process, the CUSTOMER must enter the necessary contact details for shipping and payment. There is also the option to create a customer account to save order data for future purchases. The order is bindingly completed by clicking the "Buy" button. Confirmation of the receipt of the CUSTOMER'S order occurs via email immediately after the order is sent.

3.2 If an external payment provider is selected among the payment options, the CUSTOMER will be redirected to their website to complete the purchase.

3.3 Orders exceeding quantities customary for private consumption may be rejected or canceled. The CUSTOMER will receive a notification regarding this.

3.4 Input errors, particularly items placed in the shopping cart by mistake, can be corrected by the CUSTOMER by entering the desired quantity in the shopping cart and using the available buttons. During the ordering process, the CUSTOMER can correct input errors in the various steps by navigating to the respective step using the "forward" and "back" buttons of the browser.

3.5 By completing the order, the CUSTOMER declares knowledge of the GTC, the Privacy Policy, and the Cancellation Policy.

3.6 The contract language is German.

 

4. Storage of Contract Text

The contract text is not stored by the SELLER. The order data will be sent to the CUSTOMER separately in text form (email). The GTC can also be accessed and printed in the online shop.

 

5. Right of Withdrawal

If the CUSTOMER is a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to their commercial or independent professional activity), the CUSTOMER is entitled to a right of withdrawal in accordance with statutory provisions.

 

6. Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to distance contracts:

  • For the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded.

  • For the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

  • For the delivery of goods if these were inseparably mixed with other goods after delivery due to their nature.

  • Contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

 

7. Note: Returning Products

Goods should, if possible, be returned in the original packaging with all accessories and packaging components to: Vermilion Media UG (haftungsbeschränkt) / RENEGADE FIGHTING, Gut Krusshof, Oberbenraderstr. 51, 47804 Krefeld, Germany.

The SELLER requests the use of protective outer packaging to ensure adequate protection against transport damage if the original packaging is no longer available. Damage and contamination of the goods to be returned should be avoided. CUSTOMERS are requested to return physical products as a prepaid package and to keep the proof of posting. The SELLER points out that the right of withdrawal and its consequences exist independently of compliance with this notice; it merely serves to facilitate the processing of the return.

The SELLER requests that the CUSTOMER report obvious transport damage to the carrier immediately and contact the SELLER. Failure to make a complaint or contact has no consequences for the CUSTOMER'S legal claims and their enforcement, particularly warranty rights. The CUSTOMER helps the SELLER to be able to assert their own claims against the carrier or the transport insurance.

 

8. Prices and Shipping Costs

8.1 The prices valid on the day of the order as displayed in the online shop apply. 8.2 Prices displayed in the online shop are in Euros and include statutory VAT. 8.3 For the purchase of goods delivered by parcel or other postal means: The prices displayed in the online shop do not include shipping costs for packaging and postage. Shipping costs are calculated dynamically within the ordering process and displayed in the shopping cart overview before the order is placed. 8.4 Information on delivery countries and shipping costs can be found in our FAQ.

Note on Returns: A return within Germany costs 4.99€ and will be deducted from the refund. In the case of an exchange, no return costs apply. Return costs for shipments outside of Germany must be borne by the customer themselves.

 

9. Payment Terms

9.1 The SELLER only accepts the payment methods offered during the ordering process. These are:

  • PayPal

  • Credit Card: Visa, Mastercard, Maestro

  • Klarna Invoice (Rechnung)

  • Klarna Instant (Sofort)

  • SOFORT

  • eps transfer (Austria only)

  • iDEAL (Netherlands only)

  • Apple Pay

  • Google Pay

(Sections 9.3 to 9.12 provide specific technical details for each provider, including requirements for Two-Factor Authentication (2FA) such as PIN, TAN, or biometric data).

10. Promotional Vouchers and Their Redemption

10.1 Promotional vouchers are vouchers that cannot be purchased but are issued by the SELLER as part of advertising campaigns with a specific validity period. 10.2 They are only redeemable once per order and within the specified period. They cannot be used to buy gift vouchers and may be subject to a minimum order value. 10.3 The value of the goods must at least equal the voucher amount. Vouchers are not paid out in cash and are not refunded if goods are returned. 10.4 Vouchers must be redeemed before completing the order; subsequent application is not possible. 10.5 If a return causes the total value to fall below the minimum order value of the voucher, the SELLER reserves the right to charge the original price of the goods.

 

11. Regulation on Promotional Gifts (e.g., Secret Piece)

  • Requirement: Customers receive a free gift if the order value (after discounts) reaches a specified minimum (e.g., €120).

  • Returns: if a return causes the order value to fall below the minimum, the promotional gift ("Secret Piece") will be charged at €35.

  • Settlement: This amount is offset against the refund. Alternatively, the customer may return the gift unused and in perfect condition to avoid the charge.

 

12. Value Vouchers and Their Redemption

12.1 Value vouchers are issued by the SELLER (e.g., for goodwill). They are personal, non-transferable, and cannot be purchased or paid out in cash. 12.2 Remaining balances remain on the voucher for future use.

 

13. Delivery and Shipping Conditions

13.1 Delivery is made to the address specified by the CUSTOMER. 13.2 Delivery time is specified on the product page. Shipping usually occurs within 1-5 working days. Delivery within Germany takes approximately 2-10 working days. 13.3 PreSales may take 8-12 weeks. 13.6 If a package is returned because delivery was impossible, the CUSTOMER bears the costs for re-shipping (unless they have exercised their right of withdrawal or are not responsible for the failed delivery).

 

14. Refunds

Refunds are processed automatically to the original payment method. The refund is usually processed within 14 days of arrival at the warehouse. Set items: If only part of a set is returned, the discount is forfeited, and the refund is calculated as: Set Price - Individual Price of the kept item = Refund Amount.

 

15. Retention of Title

The SELLER retains ownership of the sold items until full payment of the purchase price is received.

 

16. Warranty/Liability for Defects

Rights regarding defects in the purchased item are governed by statutory provisions.

 

17. Customer Account

17.1 Registration is free. The CUSTOMER guarantees the accuracy of their data. 17.4 Only one account per person is permitted. Minors are not allowed to register. 17.5 Both parties can terminate the account contract at any time without giving reasons.

 

18. Data Storage and Data Protection

Data protection is governed exclusively by the Privacy Policy found in the website footer.

 

19. Alternative Dispute Resolution

The SELLER is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. The EU Commission provides an ODR platform: https://www.ec.europa.eu/consumers/odr.

 

20. Final Provisions

20.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). 20.2 This choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the CUSTOMER has their habitual residence is not withdrawn.
